This applies for Canada also, kinda funny when it's - 40 out the EPA emission controlled trucks are parked , and the older trucks fly by them

That's why 2010 commercial trucks and personal vehicles both run urea??Federal smog laws are the same.Each state enforce differently.California will pass a law that the rest of the country will soon follow.
 
CA cannot require an out of state vehicle to adhere to CA emissions laws. They have no legal grounds for this.

Idk what I was thinking last night :drink[1]: DOT gets their authority from federal govt and can enforce federal laws regardless of state of origin or whether it is a personal or commercial vehicle. Emissions tampering is a $1k minimum fine I believe levied by the feds not the state.

The EPA does not conduct direct enforcement of emissions laws on the consumer level. The EPA sets policy. The individual states enforce the federal statutes, but can only do so within their scope of authority. A lawfully registered and tagged vehicle from outside of California does not come under the umbrella of California law.

Its a federal law.Your best bet is looking up A.R.B enforcement.
 
CA can enforce its laws on out of state folks. Your 40' trailer is subject to a special stamp to pull it in California. Anything over a certain length requires a permit. CA blows when it comes to driving our rigs.

I would have to say going to school in some other location would be a drastic move but head that way at your own risk is all I can say. My buddy was pulled over in his 1999 7.3l F350 for pulling his bumper pull trailer that is 26 ft. The reason: He saw smoke come out of the truck and he wanted to verify the total length. We live in NM where if you have a gvwr over 10k your good for no emissions....That didn't matter. He ended up with a "fix it ticket". Which ended up in the next trash bin.

What's the permit I would have to get. The trailer has nj tags as well. It's only for personal use not commercial. Rules still apply?
 
Ill let you all know how this goes for me. Pulling a 34' fifth wheel into cali with a deleted truck in October. I look stock but never the less it will be interesting. I may have to practice 0-60 in 5 min no to blow smoke lol

You will probably be OK, but don't blow smoke, have LOUD exhaust, and do crazy Sh*t, to draw attention. Keep the NJ tags up to date.

If NJ has Safety Inspection and/or Emission inspection to receive the new tags, it will be hard keep the tags current--!!

I've been living in San Diego and run up to sf Oakland area once a month at least for the past year. I haven't had any issues I still have nj tags
 
No! You will be fine. As a student or a military member you are a temp ca resident. You do not have to register your vechile here. You can keep it in your home state. And no if you get pulled over by police they can not write you a ticket for your vechile since it is registered in a no emissions state and you have a NJ license as well. Yes cali has very strict laws for commercial vehicles. But a Dot commercial enforcement officer will not pull over a diesel pickup and check to see if you have emissions on it if you're from out of state.. Funny how people on this form know the law. They believe everything they read. Let's just say for shit and giggles I know!

One problem homie... They can write you a ticket.
It's federal law to be emissions compliant. I'm like the op though where I'm lucky enough to be in a state that doesn't annually look for it, yet any officer can take it upon himself to cite me for committing a crime against the federal law. :(

Keep the rpms up manually by shifting it later. Can accelerate faster and cleaner :thumb
 
I'm supposed to be hauling into L.A. Next week. Kinda nervous about taking a delete commercial vehicle there.... But it's pays good so hopefully it's worth the risk.

Watch out for carb enforcement at the scales... Rethinking my previous post, it may only apply to commercial guys... Hmmmmmm sorry about that.

X2 I live in San Diego and they can't do much about my home state emission standards. If your state requires smog testing you MIGHT have to smog it in California but I don't think that you would anyways besides if you had to there are soooo many smog testing centers it would be easy to find one that will pass you for a small price.

Blowing smoke is another story though. I've talked to some guys in the LA area and they do random check points for emissions but you will be exempt. Cops are cops, not prosecuting attorneys. But they can always give you a smoke blowing ticket. Federal law or not I've lived here for a few years now and never ran into one yet. As long as your not blowing smoke stop light to stop light you will be fine.

yeah the laws here suck, but that's only registered CA trucks. Don't even worry about it, cops have better shit to do than randomly pulling over diesel trucks just because they think they might be "emission deleted"

New here but former Texas State Trooper. If you look to the Non Resident Violator Compact, http://apps.csg.org/ncic/Compact.aspx?id=142, you will find that California is not a signatory to that agreement. What that means is that they can enforce their laws in regards to Minor traffic and equipment violations on out of state vehicles.

If you are considered a commercial vehicle, that goes out the window, typically 26,001 GVWR and up.

I think your best course of action is to not sweat the small stuff...don't draw attention to yourself, don't blow smoke all over the place, if stopped, be polite and respectful, and you should be OK.

Fly under the radar, you should be good.
